1. Introduction & Platform Overview

1.1 Acceptance of Terms

These Terms & Conditions ("Terms") form a legal agreement between you and Yak Stack Solution Pvt. Ltd. ("Company," "we," "us," or "our"). By creating an account, visiting https://hamrofutsal.com, or using the HamroFutsal mobile app or portals, you agree to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1.2 Platform Services

Hamro Futsal is an online platform that connects futsal players with venue operators across Nepal. The platform includes:

  • Mobile Application — allows users to search venues, view available courts, submit booking requests, upload payment proof, leave reviews, and receive updates.
  • Website (https://hamrofutsal.com) — provides venue details, platform updates, and customer support.
  • Vendor Portal — enables venue operators to list courts, set pricing, manage schedules, and review customer bookings.
  • Super Admin Panel — used by Yak Stack Solution Pvt. Ltd. to verify vendors, review manual payments, moderate content, and maintain platform security.
1.3 Role of the Company

Hamro Futsal acts solely as an intermediary technology platform. We do not own, operate, or maintain any futsal venues or facilities listed on the platform.

2. Definitions

  • Account — a registered user or vendor profile on the platform.
  • Booking — a court reservation made through the platform.
  • Booking Request — an unconfirmed reservation pending payment verification.
  • Confirmed Booking — a reservation verified by a Vendor or Super Admin.
  • Payment Verification — The process by which Hamro Futsal reviews uploaded proof of payment before confirming a booking.
  • Platform — the Hamro Futsal Mobile App, Website, Vendor Portal, and Super Admin Panel.
  • User — any individual using the platform to find, book, or review futsal courts.
  • Vendor — an independent venue operator offering futsal courts on the platform.

3. Account Registration & Authentication

3.1 Eligibility

You must be at least 16 years old to create an account. If you register on behalf of a company or venue, you confirm that you have the authority to bind that entity to these Terms.

3.2 Authentication Methods

You may sign up or log in using:

  1. Email and Password — requires a valid email address. Passwords are stored securely using industry-standard encryption.
  2. Phone OTP — requires a valid Nepalese phone number verified via SMS code.
  3. Google Sign-In — uses your Google account details to set up your profile.
3.3 Account Security

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@hamrofutsal.com if you suspect unauthorized access. Email addresses tied to an account cannot be changed directly in the app; such changes require administrative approval.

4. Booking Rules & Process

4.1 How Bookings Work
  1. Select — choose a venue, court, date, and time slot.
  2. Temporary Hold — submitting a booking request places a temporary hold of up to 10 minutes on the selected court and time slot. During this hold, the slot is unavailable to other users.
  3. Pay & Upload — transfer funds via eSewa or Bank Transfer and upload a clear screenshot of the transaction before the hold expires.
  4. Verification — once payment is verified by a Vendor or Super Admin, your booking status changes to "Confirmed" and you receive a notification.
4.2 Booking Hold & Expiry
  • A Booking Request does not guarantee a Confirmed Booking. A booking is only considered confirmed once all required booking and payment steps have been completed and verified.
  • If payment is not completed and uploaded within the 10-minute hold window, the temporary reservation automatically expires.
  • Once a hold expires, the court and time slot immediately become available for other users to request.
  • This temporary reservation system is designed to reduce — though not eliminate — the possibility of double bookings.
4.3 Accuracy & Modifications

You are responsible for selecting the correct date, venue, and court. To modify a Confirmed Booking, contact the venue or customer support at least 12 hours before your scheduled time. Changes are subject to venue availability.

4.4 Double Bookings

In the rare case that two users submit valid payment for the same time slot due to a processing delay occurring near the end of the hold window:

  • Priority is given to the user whose payment screenshot was submitted first.
  • The second user will be offered an alternative time slot or a full refund.

5. Payment Terms & Verification

5.1 Supported Payment Methods

Hamro Futsal currently uses manual payment verification. We accept:

  • eSewa Mobile Wallet
  • Bank Transfer

The platform does not currently support automated online card processing or cash payments.

5.2 Payment Verification Guidelines

When uploading a payment screenshot, ensure it clearly shows:

  • The exact amount transferred
  • The recipient wallet ID or account number
  • The transaction ID / reference code
  • The date and timestamp
5.3 Invalid or Fake Payments

Uploading cropped, edited, reused, or fake screenshots is strictly prohibited. If a payment cannot be verified or appears fraudulent, we may cancel the booking, suspend your account, and restrict future access to the platform.

6. Cancellations, No-Shows & Refunds

6.1 Cancellations

Cancellation rights and any applicable refunds are determined by the individual venue's policy together with our separate Refund Policy. Cancellations requested less than 24 hours before the booked time are generally non-refundable.

6.2 No-Shows

If you fail to arrive for your confirmed booking without prior notice, the booking may be treated as a no-show. Any refund or rescheduling will be subject to the applicable venue policy and Hamro Futsal's cancellation policy.

6.3 Cancellations by Venues

If a venue cancels a Confirmed Booking due to facility issues or weather, you may choose to reschedule or receive a full refund.

7. Venue Rules & Customer Arrival

  • Punctuality — please arrive 10–15 minutes before your slot. Playing time starts and ends strictly at the scheduled times.
  • Venue Compliance — you must follow all posted rules at the venue, including footwear requirements.
  • Property Damage — you are financially responsible for any damage caused to venue property by you or your group.

8. Vendor Responsibilities

Vendors listing courts on Hamro Futsal agree to:

  • Provide accurate venue locations, court details, rates, and clear photos.
  • Keep booking calendars updated to prevent scheduling conflicts.
  • Honor all Confirmed Bookings at the prices listed on the platform.
  • Maintain clean, safe courts that comply with local health and safety regulations.
  • Maintain valid legal operating licenses in Nepal.

9. User Responsibilities & Conduct

Users agree to:

  • Provide accurate account details and maintain respectful communication with support staff and venue operators.
  • Refrain from violence, abuse, illegal substances, or dangerous behavior at venues.
  • Submit fair, truthful reviews based on actual experiences.

10. Prohibited Activities

You may not:

  • Upload false, edited, or reused payment screenshots.
  • Provide false contact details or impersonate others.
  • Attempt to hack, decompile, or overload platform software or servers.
  • Scrape or mine data from the platform.
  • Post abusive, offensive, or defamatory content.
  • Use the platform for any activity that is illegal under Nepalese law.

11. Reviews, Ratings & Moderation

Users who complete a booking may post ratings and reviews. Reviews must be honest, relevant, and free from offensive or inappropriate language. We reserve the right to remove fake, abusive, or extortionate reviews through the Super Admin Panel.

12. Intellectual Property Rights

All rights, logos, designs, source code, and content related to HamroFutsal belong exclusively to Yak Stack Solution Pvt. Ltd. You receive a limited, non-transferable license to use the app for personal, non-commercial purposes. You may not copy, modify, or resell any part of the platform.

13. Privacy & Data Protection

Your use of the platform is also governed by our Privacy Policy. We collect and process personal data solely to manage account access, verify bookings, process payments, and support platform operations.

14. Limitation of Liability & Disclaimers

14.1 Platform Disclaimer

Hamro Futsal is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free service.

14.2 Physical Venue Disclaimer

Futsal carries inherent risks of physical injury. Yak Stack Solution Pvt. Ltd. does not control or maintain physical venue conditions. Venues are responsible for facility safety, staffing, and equipment. The Company is not liable for injuries, property damage, or accidents occurring on venue grounds.

14.3 Liability Cap

To the maximum extent permitted by law, our total financial liability to you for any claim arising from your use of the platform is limited to the commission amount retained by us for the relevant booking, or NPR 5,000, whichever is lower.

15. Indemnification

You agree to defend and hold harmless Yak Stack Solution Pvt. Ltd., its officers, directors, and employees from any third-party claims, losses, or legal costs arising from your breach of these Terms, misuse of the platform, or misconduct at a venue.

16. Account Suspension & Termination

You may stop using the platform or request account deletion at any time by contacting support@hamrofutsal.com. We may suspend or terminate your account immediately if you violate these Terms, submit fake payment screenshots, or engage in abusive conduct.

17. Force Majeure

Neither the Company nor Vendors will be liable for delays or cancellations caused by events beyond reasonable control, including natural disasters, major power grid failures, internet disruptions, civil unrest, or governmental restrictions in Nepal.

18. Changes to These Terms

We may update these Terms periodically. Significant updates will be communicated through an in-app notice or website update. Continuing to use the platform after changes are posted constitutes acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of Nepal. If a dispute arises, both parties agree to attempt informal resolution by contacting support@hamrofutsal.com for at least 30 days before pursuing legal action. Unresolved disputes fall under the jurisdiction of the courts in Kathmandu, Nepal.

20. Miscellaneous Provisions

  • Entire Agreement — these Terms and our Privacy Policy form the complete agreement between you and Yak Stack Solution Pvt. Ltd.
  • Severability — if any part of these Terms is found unenforceable, the remaining sections remain valid.
  • Assignment — you may not transfer your account rights without our written consent. We may assign our rights as part of a corporate reorganization or sale.
